Deceased Estates Administration

Deceased Estates Administration

When a person dies, their estate must be wound up in terms of the Administration of Estates Act and either their Will (testate) or, if there is no Will, the Intestate Succession Act. Beneficiaries and surviving spouses have rights to fair and lawful distribution of the deceased’s assets according to these rules.

Key services:

  • Reporting the estate to the Master of the High Court and securing Letters of Executorship or Authority.
  • Administering testate estates in line with the Will, and intestate estates in line with the Intestate Succession Act.
  • Liaising with the Master, creditors and heirs, preparing liquidation and distribution accounts and arranging transfer of property.

Common examples:

  • Administering an estate where the deceased left a Will, ensuring that specific bequests and the residue are correctly transferred.
  • Handling an intestate estate where a surviving spouse and children must share the estate according to the “child’s share” formula.
  • Assisting a surviving spouse who suspects that a Will is invalid or was signed under undue influence.
